Welcome to Lumika. These Terms of Service ("Terms") govern your access to and use of the Lumika mobile application ("Lumika," "the App," "we," "our," or "us"). By creating an account or using the App, you agree to these Terms. If you do not agree, please do not use Lumika.

1. Eligibility

You must be at least 13 years old to create an account and use Lumika. If you are under the age of majority in your country, you confirm that you have your parent or legal guardian's permission to use the App.

1. Your Account

2.1 Account Creation You may create an account using email/password, Google Sign-In, or Apple Sign-In. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

2.2 Accurate Information You agree to provide accurate and current information when creating your account and to keep it updated.

2.3 Account Termination You may delete your account at any time from Profile > Settings, or by visiting https://www.lumikaenglish.com/delete-account. We may suspend or terminate your account if you violate these Terms.

1. Description of Service

Lumika is a gamified English-learning application that includes vocabulary practice, story reading, spaced repetition exercises, level progression aligned with CEFR standards (A1–C1), a card collection ("egg") system, daily quests, and leaderboards.

1. Virtual Items and In-App Content

4.1 Nature of Virtual Items Lumika includes virtual items such as cards, eggs, badges, XP, and league rankings ("Virtual Items"). Virtual Items are a representation of your progress and engagement within the App.

4.2 No Real-World Value Virtual Items have no monetary value, cannot be exchanged for real money or any other item of value, cannot be sold, traded, or transferred outside the App, and exist solely for use within Lumika at our discretion.

4.3 Randomized Content Some features of Lumika (such as "egg" openings) involve randomized outcomes in which you receive a Virtual Item from a defined set of possible outcomes. Any probabilities disclosed in the App are for informational purposes and may be adjusted from time to time.

4.4 No Guarantee of Availability We may modify, rebalance, or discontinue any Virtual Item, feature, or game mechanic at any time, with or without notice.

1. Subscriptions (Lumika Premium)

5.1 Subscription Plans Lumika offers optional auto-renewing subscription plans ("Lumika Premium") on a monthly or yearly basis. Premium subscribers receive expanded access to features such as unlimited egg openings, level solves, and story access, as described in the App at the time of purchase.

5.2 Free Trial Some subscription plans may include a free trial period (e.g., 7 days). If you do not cancel before the trial ends, you will be automatically charged for the subscription at the price displayed at the time of purchase.

5.3 Billing and Auto-Renewal Subscriptions are billed through the Apple App Store or Google Play Store, depending on your device. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date.

5.4 Managing and Canceling Your Subscription You can manage or cancel your subscription at any time through your Apple ID account settings (App Store) or your Google Play account settings. Lumika does not have access to your payment information and cannot process cancellations or refunds directly.

5.5 Refunds All purchases are subject to the refund policies of the Apple App Store or Google Play Store. We do not directly issue refunds; please contact Apple or Google support for refund requests.

5.6 Price Changes We may change subscription prices from time to time. Any price changes will be communicated in advance and will apply to your next billing cycle, in accordance with the applicable app store's policies.

1. Acceptable Use

When using Lumika, you agree not to:

• Use the App for any unlawful purpose

• Attempt to access, tamper with, or use non-public areas of the App or its systems

• Reverse-engineer, decompile, or disassemble any part of the App

• Use automated systems (bots, scripts) to interact with the App or manipulate progress, leaderboards, or Virtual Items

• Exploit bugs or vulnerabilities in the App instead of reporting them to us

• Impersonate another person or misrepresent your affiliation with any person or entity

• Harass, abuse, or harm other users

We reserve the right to suspend or terminate accounts that violate these rules.

1. Intellectual Property

7.1 Our Content The App, including its design, graphics, text, characters, illustrations, audio, and underlying code, is owned by Lumika or its licensors and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License We grant you a limited, non-exclusive, non-transferable, revocable license to use Lumika for your personal, non-commercial use, subject to these Terms.

7.3 Third-Party Content Some images and content within the App are sourced from third-party providers (such as Pexels) under their respective licenses.

1. Disclaimers

Lumika is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that it will meet your specific learning goals or exam requirements (including but not limited to IELTS or other standardized tests).

1. Limitation of Liability

To the maximum extent permitted by applicable law, Lumika and its developers shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the App, including but not limited to loss of data, loss of progress, or loss of Virtual Items.

1. Changes to the App and These Terms

We may update, modify, or discontinue features of the App, and we may revise these Terms from time to time. If we make material changes, we will notify you within the App or update the "Last Updated" date above. Your continued use of Lumika after changes take effect constitutes acceptance of the revised Terms.

1. Governing Law

These Terms are governed by the laws of the Republic of Turkey, without regard to its conflict of law principles, to the extent permitted by the applicable app store's terms and local consumer protection laws in your jurisdiction.
